I invite your attention to the various references cited above, wherein, instructions have already been issued to all the Superintending Engineers of Distribution Circles to take immediate steps to furnish the details to the Commissioner/ Employees Provident Fund but no follow up action been taken in the matter. It is ascertained that the case in W.P. No.44494/2002 (Labour), W.P. No.4119/2004 and W.P. M.P. No.4836/2004 are likely to be come up by the 1st week of November 2011 for hearing. ---2

2) In spite of repeated instructions issued, certain Superintending Engineers have not shown their adequate attention into the matter. The Board has been warned by the High Court of Judicature at Madras and have issued orders in a time bound manner in four spells. Hence, the Superintending Engineers are once again requested to furnish the duly corrected 10C forms to the Commissioner, RPF Organisation immediately so as to avoid contempt of Court. The Superintending Engineers may also be requested to approach the Unions for TNEB Pensioners Welfare Association and to request them to obtain the particulars for compliance of the issue.
3) Further, the Superintending Engineers are also requested to address the Commissioner/ RPF concerned for the refund of the amount recovered from the employees who have been covered under CPF towards subscriptions for the EFPS 1971, atleast with the available records in the 10C forms.
4) Hon’ble Judge also directed the Board to submit what steps have been taken regarding the compliances as per the statement submitted by the EPF Counsel.
5) I am also to enclose herewith the copy of the statement received from the RPF/ Chennai.
6) The matter may be taken up under top priority and a status report/ action taken report may be sent to this office urgently.
